1. Scope

1.1 These GTC apply to all contracts for the delivery of goods by Oasis Luxe (“we”, “us”) to consumers via the online shop OasisLuxe.com.

1.2 “Consumer” means any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

3. Conclusion of Contract

3.1 Product descriptions in the shop are non-binding.

3.2 By clicking “Buy” you submit a binding offer to purchase.

3.3 The contract is concluded when we send you an order confirmation by e-mail.

4. Prices and Payment

4.1 All prices are exclusive of VAT pursuant to § 19 UStG (small-business regulation) and plus any shipping costs.

4.2 Payment methods accepted: credit card, PayPal, or pre-payment (bank transfer).

4.3 Payment becomes due immediately upon conclusion of the contract.

5. Delivery

5.1 We deliver within the EU. Estimated delivery time: 3–5 business days.

5.2 In the event of force majeure or other disruptions beyond our control, delivery times shall be extended accordingly.

6. Reservation of Title

The delivered goods remain our property until full payment has been received.

7. Right of Withdrawal

7.1 Consumers are entitled to withdraw from the contract.

7.2 We grant a 30-day withdrawal period from the date on which you—or a third party designated by you—take(s) possession of the goods (this extends the statutory 14-day period under Directive 2011/83/EU).

7.3 You bear the direct cost of returning the goods.

7.4 Withdrawal Instructions

To exercise your right of withdrawal, please inform us (Oasis Luxe, Vivienne Shahid, Bachstraße 69a, 32756 Detmold, Germany; E-Mail: [email protected]) by means of a clear statement (e.g. a letter sent by post or e-mail). You may use the model withdrawal form available on our website, but this is not mandatory.

7.5 Effects of Withdrawal

If you withdraw, we will reimburse all payments received from you (excluding any extra costs for express delivery) without undue delay and at the latest within 14 days from the day on which we receive notification of your withdrawal. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back. Please return the goods immediately and in any event no later than 14 days from the day on which you communicate your withdrawal. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

7.6 Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

• Goods made to the consumer’s specifications or clearly personalized;
• Sealed goods which are not suitable for return for reasons of health protection or hygiene, once unsealed after delivery;
• Perishable goods or goods with a limited shelf-life.

8. Warranty (Liability for Defects)

Statutory warranty applies: you must notify us of any defects within two years of delivery. In case of a defect we shall, at our discretion, provide a remedy by repair, replacement, or refund.

9. Liability

We are liable without limitation for intent and gross negligence. For simple negligence, our liability is limited to foreseeable, contract-typical damages, except in the case of injury to life, body, or health or under the Product Liability Act. Liability for loss of data is excluded.

11. Dispute Resolution

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/. Although as of 20 June 2025 we are no longer obliged to link to that platform, we continue to provide the above link for your convenience. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

12.1 Place of jurisdiction: Detmold, Germany (for consumers only if and to the extent permitted by law).

12.2 Applicable law: German law under exclusion of conflict-of-law rules, provided that EU consumer protection provisions remain unaffected.

12.3 We reserve the right to update or amend these GTC at any time. Changes will be communicated on our website.
